Senior Manager, Senior Counsel - Artificial Intelligence

As a member of Capital One's Tech Reg Legal Business Counsel team you'll apply your legal, strategic, and analytical skills to programs and initiatives driving Capital One's most innovative technology and solutions. You'll dive in to understand the processes, governance, and products that Capital One's Artificial Intelligence (AI), Machine Learning (ML) and Generative AI teams deliver to the enterprise, and be the legal partner that supports cutting edge innovation and responsible Artificial Intelligence development. You'll be a dedicated legal partner supporting the enterprise AI/ML organization and serve as our legal department AI, ML and Generative AI subject matter expert. And you'll do it all in a collaborative, supportive environment that values your insight, promotes continuous learning, and rewards creative thinking.

To succeed in this role, you'll need strong business and legal skills, with an ability to draw on prior experience relevant to identifying legal issues associated with the development of machine learning models and algorithms, as well as frontier artificial intelligence. Additionally, written and oral communication and organizational skills are key, as is good judgment and the ability to focus on what really matters to drive business initiatives forward while clearly defining and strategizing on ways to reduce legal risk. You should have a successful track record of thriving in a fast paced, entrepreneurial and dynamic environment.

In this role, you'll be part of a team that:

  • Provides strategic advice: You'll be something of an investigator: you'll work on projects that impact our many lines of business and horizontal teams (Branded & Partnerships Cards, Retail Bank, Commercial Bank, Auto Finance, Enterprise products like Capital One Shopping, and internally developed products for our Technology, HR, Finance, and other supporting organizations), so you'll drill down into how we do what we do, and why we do what we do, so we can build a better way. You'll understand the business' objectives, understand the full legal, policy, and regulatory landscape, and work through uncharted territory as you apply the law to business initiatives.

  • Translates the law for the business, and translates business intent for the lawyers: You'll need to understand the legal and regulatory environment (e.g., AI Risk Management Frameworks, AI/ML best practices and responsible use, proposed AI legislation and regulation), understand the business (e.g., consumer credit, consumer budgeting and finance, all those other things related to how we run our business both inside and out), understand the technology (foundation models, agentic AI, APIs, mobile and web applications, SaaS), understand the teams (e.g., business analysts, product, engineering and design professionals), and put them all together as a trusted business advisor. You'll translate between business intent, regulatory requirements, legal guardrails, best practices, etc. You won't need to know everything about everything, but you'll need to know a little about a lot, and know how to communicate legal requirements to the business, and business requirements to legal subject matter experts.

  • Partners to foster innovation: You'll collaborate closely with colleagues across the Legal Department (including and especially the Intellectual Property legal team) to fully evaluate and scale risk. You'll work to push responsible innovation in challenging gray areas.

Basic Qualifications:

  • Juris Doctor from an accredited law school

  • Active member in good standing of at least one state bar

  • At least 4 years of experience as an attorney in a law firm environment, at a government agency, as a military judge advocate, or as in-house counsel

Preferred Qualifications:

  • Personal interest in technology

  • 2+ years of experience in domestic and international artificial intelligence-specific legislation, regulation and risk management frameworks

  • 2+ years of experience in domestic and international data privacy laws

  • Experience counseling and negotiating AI/ML research and university agreements.

  • Experience negotiating generative AI service agreements.

The minimum and maximum full-time annual salaries for this role are listed below, by location. Please note that this salary information is solely for candidates hired to perform work within one of these locations, and refers to the amount Capital One is willing to pay at the time of this posting. Salaries for part-time roles will be prorated based upon the agreed upon number of hours to be regularly worked.

McLean, VA: $193,000 - $220,300 for Sr. Manager, Sr. Counsel New York, NY: $210,500 - $240,300 for Sr. Manager, Sr. Counsel Richmond, VA: $175,500 - $200,300 for Sr. Manager, Sr. Counsel

Candidates hired to work in other locations will be subject to the pay range associated with that location, and the actual annualized salary amount offered to any candidate at the time of hire will be reflected solely in the candidate's offer letter.

This role is also eligible to earn performance based incentive compensation, which may include cash bonus(es) and/or long term incentives (LTI). Incentives could be discretionary or non discretionary depending on the plan.
