Learn more about the UC Office of the President DEPARTMENT OVERVIEW The Systemwide Office of Civil Rights (SOCR) under the leadership of the Executive Director provides direction and support for the university's 10 campuses and the Lawrence Berkeley National Laboratory (LBNL), as well as the Office of the President. SOCR assists in developing and implementing systemwide initiatives, policies, procedures, guidance, and best practices to proactively prevent and respond to reports of discrimination, including, harassment. In certain circumstances, SOCR provides investigative support, as well as develops and delivers education and training programs to campus civil rights offices and other university partners involved in preventing and responding to all forms of discrimination, harassment, and related retaliation based on protected categories (e.g., race, ethnicity, disability, sex, etc.). SOCR also is the policy owner for the systemwide Sexual Violence and Sexual Harassment Policy and Anti-Discrimination Policy and manages systemwide training on those policies for all UC campus community members. The Systemwide Anti-Discrimination Office, which is part of the Systemwide Office of Civil Rights (SOCR), provides direction and support for the Local Implementation Officers and civil rights offices at the University's 10 campuses, the Lawrence Berkeley National Laboratory (LBNL), and the academic medical centers, as well as the Office of the President. SOCR assists in implementing systemwide initiatives and best practices in protected category discrimination and harassment, including related retaliation, prevention and response with respect to UC's Anti-Discrimination Policy, in particular to ensure systemwide compliance with applicable federal and state and local laws, including Title VI and Title VII, as well as Title IX (sex discrimination and pregnancy discrimination/harassment), the Americans with Disabilities Act, Section 504, and the Age Discrimination Act. This office in SOCR also provides investigative and strategic guidance, investigative support in conflict-of-interest cases or as determined appropriate, appeals support, and develops and delivers education and training to the Local Implementation Officers and civil rights offices and other University partners involved in preventing and responding to harassment, discrimination, and retaliation covered by the Anti-Discrimination Policy. POSITION SUMMARY Reporting to the Executive Director of SOCR, the Systemwide Anti-Discrimination Director serves on the ED's senior leadership team as a strategic thought partner with the other two key office leads, the Systemwide Title IX Director and Systemwide Director of Disability Rights. The position also:
- Leads a team dedicated to the Anti-Discrimination Policy, as part of the Systemwide Office of Civil Rights, and the compliance function that is strategically and operationally important to the governance of the University. The team has expertise in a broad array of protected categories and civil rights issues covered by the Anti-Discrimination Policy and the Director is responsible for the supervision and professional development of their direct reports.
- Partners with other senior managers to establish strategic plans and objectives that align with UC Presidential and other priorities.
- Makes final decisions on administrative or operational matters, in consultation with the Executive Director for the Systemwide Office of Civil Rights, and ensures effective achievement of objectives in a thoughtful, innovative, ethical, and fiscally responsible manner. Advises Senior Leadership in sectional responsibilities such as investigations/resolutions/appeals, data analysis, research, healthcare contexts, and policy development.
- Serves as the systemwide subject matter expert on all issues arising within UC with respect to application of and implementation of the Anti-Discrimination Policy, which applies to all faculty, staff, students, and other persons participating in or seeking to participate in University programs and services.
- Periodically reviews and updates/modifies the Anti-Discrimination Policy as necessary and appropriate, and serves as the primary contact person for questions about the policy.
- On a regular and recurring basis, develops and distributes to the campuses/locations timely and comprehensive guidance, templates, and other documents to ensure high quality, consistent, fair, compassionate implementation of the Anti-Discrimination Policy across the system, as well as related procedures and adjudication frameworks. This guidance and support will be informed by feedback from the Local Implementation Officers and other key stakeholders regarding their key priorities, issues, concerns, and needs and will comply with updates to applicable law and policy.
- On a regular and recurring basis, communicate through group and 1:1 meetings with campus/location Local Implementation Officers with respect to trends, patterns, and best practices affecting or informing implementation of the Anti-Discrimination Policy. Also serves as an ambassador for the Anti-Discrimination Policy and is expected to form strong partnerships and networks with key UCOP and campus/location stakeholders.
- On a regular and recurring basis, leads efforts for tracking trends in law and policy at the federal, state, and local level and providing training, education, workshops, webinars, etc. to the campuses, national laboratories, and academic medical centers with respect to complex and sensitive issues under the Anti-Discrimination Policy.
- As appropriate and necessary, manages prompt, comprehensive and high-quality investigations by SOCR Principal Investigators under the Anti-Discrimination Policy involving conflicts of interest, UCOP staff, or in other appropriate circumstances.
- Serves as a liaison to legislative partners and as a subject matter expert to brief Senior Leaders and other key stakeholders regarding issues specific to the Anti-Discrimination Policy.
Responsibilities 30% Policy Development and Compliance
- Serve as the Anti-Discrimination Policy subject matter expert, with broad and thorough knowledge of the compliance function and business operations related to the Anti-Discrimination Policy.
- Track trends in law and policy at the federal and state level to ensure full compliance and best practices; brief senior leaders on trends.
- Respond to or facilitate responses to policy questions from internal and external constituents.
- Review and update the Anti-Discrimination Policy in accordance with changes in law and policy needs. Distribute related communications and training to internal constituents.
- Develop timely and comprehensive guidance, templates, and other documents and distribute them to internal constituents to ensure policy compliance and consistency across the system.
- Oversee the development and coordination of policy communications; formulate long-term strategies for education and implementation.
- Assist in responding to federal and state agency reviews or requests for information on behalf of the University.
- Develop, implement, and communicate policy-related procedures and adjudication frameworks.
- Serve as liaison to stakeholders, including legislators, senior leaders, etc. with respect to the Anti-Discrimination Policy.
30% Client Service
- Provide expertise in complex situations and develop solutions in areas of critical decision making with respect to the Anti-Discrimination Policy.
- Lead the provision of training, education, workshops, webinars, etc. to UC campuses, national laboratories, and academic medical centers.
- Serve as an ambassador for the Anti-Discrimination Policy and form strong partnerships and networks with key UCOP and campus/location stakeholders, senior leaders, and legislative partners.
- Regularly communicates with campus/location Local Implementation Officers with respect to trends, patterns, and best practices affecting or informing implementation of the Anti-Discrimination Policy.
- Educate and influence senior and executive leadership with respect to issues arising under the Anti-Discrimination Policy.
- Host regular workshops, check-ins, listservs, communities of practice, and/or consultations with the Local Implementation Officers and civil rights offices and partners, providing them an opportunity for regular consultation, input, and feedback regarding campus priorities related to the Anti-Discrimination Policy.
20% Management and Leadership
- Select, develop, and evaluate staff to ensure effective and efficient operation of the Anti-Discrimination office and ensure delivery of high quality, timely services.
- Serve as a thought partner and key advisor to the Executive Director of the Office of Civil Rights with respect to functional operations and budget needs.
- Work with management in all areas to promote a culture of accountability, ethics, inclusion, respect, compliance, and wellbeing.
20% Investigation and Resolution
- As appropriate and necessary, manage the timely, high-quality, and comprehensive resolution of investigations under the Anti-Discrimination Policy.
- Ensure professional development and training for SOCR Principal Investigators.
- Ensure trauma-informed, culturally competent, and other best practices for investigations and resolutions.
- Collaborate with other UCOP and campus stakeholders regarding best investigative and resolution strategies, practices, and approaches.
Required Qualifications
- Minimum of 10 years combined of relevant advanced education and experience working in a higher education setting or a related field (such as a federal or state agency or K-12 education setting or a law firm specializing in civil rights) addressing civil rights issues in education, housing, healthcare, employment, or similar areas involving, in particular Title VI and Title VII, as well as Title IX, ADA, Section 504, the Age Discrimination Act, and other federal and state civil rights laws.
- Minimum of 2 years of experience in higher education preferred.
- Demonstrated ability to direct a variety of program areas within compliance. Demonstrated ability to work with management to identify and mitigate key compliance risks.
- Demonstrated ability to communicate, both verbally and in writing, complex findings and recommendations in a clear and concise manner. This includes findings for specific compliance program issues and risk areas.
- Advanced interpersonal skills, including negotiation and communication that have been demonstrated across a wide variety of audiences for different areas of compliance.
- Knowledge of policies, practices and systems, human and other resource planning, analytical and comprehensive project management skills.
- Ability to work independently and collaboratively within a team environment.
- Experience addressing civil rights issues in education and/or employment, including Title VI, Title IX, ADA, Section 504, etc.
Preferred Qualifications
- Experience addressing civil rights issues in an academic medical center or other similar healthcare setting.
Education
- Bachelor's degree in related area and / or equivalent experience / training required.
- JD or other advanced degree preferred.
Travel Requirements
- 5% On an annual basis, occasional travel to campuses may be required for site visits, education programming, etc.
SPECIAL CONDITIONS This position is eligible for a hybrid work arrangement. The selected candidate must reside in, or be willing to relocate to, California and will be required to report to work in Oakland, CA on an agreed upon schedule. Payscale: $210,000 - $245,000, commensurate with experience The University of California, Office of the President, is required to provide a reasonable estimate of the compensation range for this role. This range takes into account the wide range of factors that are considered in making compensation decisions including but not limited to experience, skills, knowledge, abilities, education, licensure and certifications, and other business and organizational needs.
